These Terms of Service apply to all Sites, mobile applications, URLs, and related services, sales, marketing, or events owned or operated by Detour App, LLC and/or its parents, subsidiaries, or affiliates (collectively, "Company", "Detour", "We", or "Us"). Please read these Terms of Service carefully before you use the Sites or the App. By using the Sites or the App, or by clicking to accept or agree to these Terms of Service when that option is presented to you, you accept and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms of Service or the Privacy Policy, you must not access or use our App or Sites.
The Sites and the App are offered and available to users who reside in the United States or any of its territories or possessions. By using the Sites or the App, you represent and warrant that you meet these eligibility requirements and are legally able to form a binding contract with the Company. If you do not meet these requirements, you must not access or use the Sites or the App.
We may revise and update these Terms of Service from time to time at our sole discretion. All changes are effective immediately when we post them and apply to your access to and use of the Sites and the App thereafter. Your continued use of the Sites or the App after posting of revised Terms of Service constitutes your acceptance of and agreement to the modifications. You are expected to review this page periodically so you remain aware of any changes.
We reserve the right to withdraw or change the Sites and App, and any service or material we provide on them, without notice. We will not be liable if, for any reason, all or any part of the Sites or the App are unavailable at any time or for any period. From time to time we may restrict access to parts or all of the Sites or App, including to registered users.
You are responsible for making all arrangements necessary to have access to the Sites and the App. You must ensure that all persons who access the Sites or the App through your internet connection are aware of these Terms of Service and comply with them. To access certain features, you may be required to provide registration details or other information. You agree that all information you provide is correct, current, and complete, and that the Company may use such information consistent with the Privacy Policy.
If you are provided a user name, password, or other credentials as part of our security procedures, you must treat such information as confidential and must not disclose it to any other person. Your account is personal to you; do not provide others access to your account. You agree to notify us immediately of any unauthorized access to your account or any other security breach.
We reserve the right to disable any user name, password, or other identifier at any time at our sole discretion, including in the event we believe you have violated these Terms of Service.
Important: Detour is designed to process visual search primarily on-device. Predictive Search is optional, thumbnail-only, and requires explicit opt-in.
1/ On-device processing: Detour performs Visual Search locally on your device to extract coordinates and identify candidate places based on the image or photo selected. The default and preferred behavior is local processing; local extraction is used to generate nearby place candidates.
2/ Apple Maps lookup: Coordinates extracted on-device may be used to query Apple Maps to produce nearby place results. That Apple Maps lookup requires a network request to Apple and may involve sending the coordinates (only) to Apple Maps.
3/ Predictive Search (optional): If you choose to use Predictive Search, Detour will transmit a very small, low-resolution thumbnail of the selected image to ChatGPT solely to produce improved place suggestions. No metadata is transmitted with that thumbnail: Detour does not transmit coordinates, EXIF data, timestamps, device identifiers, or other image metadata. Predictive Search is strictly opt-in and may be disabled at any time in Privacy Settings.
4/ Transient use of thumbnails: Thumbnails sent for Predictive Search are used only to generate a suggestion and are transient. Detour does not retain predictive thumbnails beyond the immediate session. Please review our Privacy Policy for additional detail on retention and vendor practices.
5/ Third-party services: Predictive Search uses third-party AI services. You agree that, when you opt in to Predictive Search, Detour may transmit only the described low-resolution thumbnail to that third party for analysis. You also acknowledge that use of third-party services is subject to the third party's terms and privacy practices.
Currently, Detour focuses on saving and organizing the places you love and on visual discovery features; in-person meetups and same-week physical meet features are planned for future releases and are not part of the current version. Regardless, to the extent users do arrange meetings or interactions that occur outside the App (whether arranged directly, through shared information, or through third-party communications), the Company is not responsible for any interactions, activities, or incidents that occur outside of the App. This includes, but is not limited to:
By using the App, you acknowledge and agree that the Company is not liable for any harm, loss, or damage resulting from interactions, activities, or incidents that take place off the App. Users are encouraged to report concerns or violations to our support team.
The Sites, the App, and all content and materials contained therein (including information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by the Company, its licensors, or other providers of such material, and are protected by U.S. and international intellectual property laws. These Terms of Service permit you to use the Sites and the App for personal, non-commercial use only.

All User Contributions must comply with the Content Standards in these Terms of Service. Any User Contribution you post will be considered non-confidential and non-proprietary.
By providing any User Contribution, you grant the Company and its affiliates and service providers a non-exclusive, worldwide, royalty-free, transferable license to use, reproduce, modify, perform, display, distribute, and otherwise disclose such material in connection with the operation of the Sites and the App and Detour’s business.

We may disclose your identity or information about you to third parties who claim that material you posted infringes their rights. We may also take legal action or refer matters to law enforcement as necessary. We may suspend or terminate your access to the Sites or the App for violations of these Terms of Service.
You waive and hold harmless the Company and its affiliates, licensees, and service providers from any claims resulting from actions taken during investigations or as a consequence of investigations by the Company or law enforcement authorities. We do not undertake to review all materials before they are posted and cannot ensure prompt removal of objectionable material.

Access from other jurisdictions may not be lawful; if you access from outside the United States, you do so on your own initiative and are responsible for compliance with local law.
Your use of the Sites and the App, their content, and any services or items obtained through them is at your own risk. The Sites and the App are provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, the Company disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE COMPANY, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITES OR THE APP, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, EVEN IF FORESEEABLE.
You agree to defend, indemnify, and hold harmless the Company and its affiliates, licensors, and service providers from and against any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of the Sites or the App.
All matters relating to the Sites, the App, and these Terms of Service and any dispute arising herefrom shall be governed by and construed in accordance with the internal laws of the State of Delaware, without regard to conflict of law provisions. Any legal action arising from or related to these Terms of Service shall be brought exclusively in federal or state courts located in the State of Florida. We retain the right to bring proceedings in your country of residence or other relevant jurisdictions when appropriate.
ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OF SERVICE OR THE SITES OR THE APP MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE THE CLAIM IS PERMANENTLY BARRED.
No waiver by the Company of any term or condition shall be deemed a further or continuing waiver of such term or any other term, and failure to assert a right or provision does not constitute a waiver. If any provision is held invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms of Service and our Privacy Policy constitute the entire agreement between you and Detour App, LLC with respect to the Sites and the App and supersede all prior agreements and understandings.
